BuyQuick Nigeria — Marketplace Policy, Disclaimer & Terms of Use (Escrow‑Hold Model)
Terms and conditions for the BuyQuick escrow marketplace.

Plain‑English summary: BuyQuick provides a digital marketplace where buyers and sellers meet. We are not the seller of items listed by users and not a logistics company. We provide a funds‑holding (escrow‑style) feature within the app: buyer’s payment is held until the buyer confirms delivery or an auto‑release window expires. No payment outside the app is allowed; doing so voids any protection and is at your own risk.
1) Acceptance & Eligibility
1.1. By tapping “I Agree” or using BuyQuick, you accept these Terms and all policies referenced in them.
1.2. You must be 18+ and have capacity to contract under Nigerian law.
1.3. Where you act for a business, you confirm authority to bind that business.
2) Definitions
- Buyer: a user who pays for a product listed by a Seller.
- Seller: a user who lists, markets, and supplies products.
- Funds‑Hold / Escrow: a feature where we hold the Buyer’s payment until release conditions occur.
- Order: a confirmed purchase of a listed product via the app.
- Delivery Confirmation: Buyer’s in‑app confirmation or a verified carrier status of “delivered”.
3) Our Role (Marketplace Only)
3.1. BuyQuick does not own or manufacture items listed by users and is not a party to contracts of sale between Buyers and Sellers.
3.2. Negotiation of price, product specifications, and delivery method is solely between Buyer and Seller.
3.3. Our role is limited to: operating the platform, processing in‑app payments via licensed partners, and holding funds pending release.
3.4. We may provide dispute tools and basic checks, but decisions to buy/sell/deliver are your sole discretion and risk.
4) No Off‑Platform Payments or Deals
4.1. All payments must occur within the app.
4.2. If you pay or receive money outside BuyQuick (cash, transfer, third‑party links), you breach these Terms, you lose Buyer/Seller protection, and you proceed at your own risk.
4.3. We may cancel orders, withhold features, or suspend/terminate accounts involved in off‑platform payments.
5) Listings & Prohibited Items
5.1. Sellers must ensure listings are accurate, lawful, and complete (true price, condition, quantity, clear photos).
5.2. Prohibited (illustrative, not exhaustive): illegal drugs; weapons/ammunition/explosives; stolen, counterfeit or pirated goods; human or endangered‑species parts; pornographic or sexually explicit materials; medical/clinical devices requiring prescriptions; hazardous chemicals; financial instruments, virtual assets or securities offered in violation of law; gambling services; spyware/malware; any item restricted by Nigerian law, regulators, or BuyQuick policy.
5.3. We may remove or block listings that violate law or policy.
6) Pricing, Taxes & Fees
6.1. Sellers set prices and are responsible for all taxes, duties, and regulatory charges applicable to their sales.
6.2. We may charge platform and/or payment fees, shown at checkout or in the Seller dashboard.
6.3. BuyQuick may offer promotions subject to specific terms.
7) Payments & Funds‑Hold (Escrow) Rules
7.1. Buyer pays through the app; we confirm receipt and hold funds (less applicable fees) until release under clause 7.3.
7.2. Shipping & Proof: Seller must ship/deliver within the stated handling time and upload acceptable proof (e.g., trackable carrier number, signed delivery note, or location‑stamped handover evidence).
7.3. Release Conditions (whichever occurs first):
(a) Buyer taps “Confirm Delivery”;
(b) Carrier shows “delivered” and 72 hours pass without a dispute; or
(c) A BuyQuick dispute decision awards funds to Seller.
7.4. Non‑Delivery/Not‑as‑Described: If Buyer raises a dispute before 7.3 is met, funds remain on hold pending resolution (see clause 9).
7.5. Time‑outs: If Seller fails to provide shipment proof within 5 days after Order, Buyer may cancel for a full refund.
7.6. BuyQuick may place administrative holds, reversals, or chargebacks where required by law, card schemes, banks, or fraud controls.
8) Delivery & Risk of Loss
8.1. Title and risk pass per the parties’ agreement and applicable law—typically when the item is delivered to the Buyer or to the carrier on Seller’s instruction.
8.2. Buyers must provide accurate delivery details and be available to receive items.
8.3. Sellers are responsible for adequate packaging and lawful transport.
9) Disputes Between Buyer & Seller
9.1. Start disputes in‑app within 72 hours after carrier “delivered” scan or Buyer’s receipt, whichever comes first.
9.2. Provide evidence (photos, videos, chats, shipment docs).
9.3. Resolution: We may (acting reasonably)
(a) release funds to Seller;
(b) refund Buyer (partial or full); or
(c) require return/re‑delivery or other remedy.
9.4. Our decision is made on the available evidence and platform records and is final on the platform (without limiting your court/arbitration rights).
9.5. Abuse of disputes (e.g., false claims) may lead to account action.
10) Chargebacks & Reversals
10.1. If a payment instrument provider (bank, card scheme, wallet) reverses a transaction, we may debit Seller or recover from future payouts.
10.2. Sellers must respond promptly to chargeback evidence requests.
10.3. We may share transaction details with payment partners to defend legitimate sales.
11) KYC/AML, Sanctions & Fraud Controls
11.1. We may require identity verification (KYC), address checks, and other due‑diligence, and may suspend features pending completion.
11.2. You confirm that funds and items are lawful and not connected to money laundering, terrorism financing, or sanctions breaches.
11.3. We may report suspicious activity to competent authorities and take action to prevent fraud.
12) Data Protection & Privacy
12.1. We process personal data in line with our Privacy Policy and applicable Nigerian data protection laws.
12.2. You must only access and use other users’ data (e.g., delivery address) for the specific transaction and keep it secure.
12.3. Do not export, sell, or misuse other users’ data obtained through the platform.
13) Communications & Records
13.1. Keep negotiations and key confirmations within the app so they can be referenced in case of disputes.
13.2. Electronic records, timestamps, and logs generated by the platform may be used as evidence.
14) Intellectual Property & Content
14.1. You grant BuyQuick a non‑exclusive, worldwide, royalty‑free licence to host, display, and distribute your listings, photos, and descriptions for marketplace purposes.
14.2. Do not infringe the IP rights of others; repeated infringement may lead to termination.
14.3. You warrant that your content is accurate, lawful, and does not mislead.
15) Seller Obligations & Warranties
15.1. Sellers warrant that items are as described, lawfully sourced, and fit for purpose.
15.2. Sellers must honour warranty/return obligations communicated in listings and required by law.
15.3. Sellers must respond to Buyer messages and fulfil orders on time.
16) Platform Availability & Changes
16.1. We strive for high availability but do not guarantee uninterrupted or error‑free service.
16.2. Features may change; we may add, suspend, or remove features with notice where reasonable.
16.3. Scheduled maintenance or security updates may affect availability temporarily.
17) Limitation of Liability
17.1. To the maximum extent permitted by law, BuyQuick is not liable for:
(a) the quality, safety, legality, or fitness of items;
(b) the acts/omissions of Buyers, Sellers, or couriers;
(c) losses from off‑platform payments or communications;
(d) indirect, incidental, or consequential damages.
17.2. Our total aggregate liability for any claim relating to an Order will not exceed the amount of platform fees we earned on that Order.
17.3. Nothing excludes liability that cannot be excluded by law.
18) Indemnity
18.1. You indemnify and hold BuyQuick harmless from third‑party claims arising from your breach of these Terms, your listings, or your misuse of the platform.
19) Suspension & Termination
19.1. We may suspend or terminate accounts for violations (e.g., off‑platform payments, fraud, prohibited items).
19.2. Upon termination, pending funds may be held or released consistent with law, network rules, and these Terms.
20) Governing Law & Dispute Resolution
20.1. These Terms are governed by the laws of the Federal Republic of Nigeria.
20.2. Any dispute with BuyQuick shall first go through our internal complaints process (support in‑app/email).
20.3. If unresolved within 30 days, the dispute shall be referred to arbitration at the Lagos Multi‑Door Courthouse (LMDC) under its rules; one arbitrator; proceedings in English; seat in Lagos; costs as directed by the tribunal.
20.4. The foregoing is without prejudice to statutory rights to approach competent courts.
21) Updates to Terms
21.1. We may update these Terms to reflect legal, security, or product changes.
21.2. Material changes will be notified in‑app or by email; continued use after the effective date constitutes acceptance.
22) Notices & Contact
22.1. Official notices may be delivered in‑app or to your registered email.
22.2. You must keep your contact details current.
23) Service Charges
23.1. A service charge of 5% applies to every successful purchase.
23.2. This charge applies to the seller of the product.
23.3. In a case of dispute resulting to refunds, the 5% charge in (23.1) is fully refundable.
24) Sellers
24.1. Only list items you own or are authorized to sell.
24.2. Be honest and accurate in your product descriptions.,
24.3. No counterfeit, illegal, or restricted items.,
24.4. Buyer-Seller communication must remain respectful and on-platform.,
24.5. We reserve the right to review, suspend, or remove listings that violate policy.,
24.6. We charge 5% on every successful sale.,
24.7. After items are delivered, you must insist buyer approve delivery before leaving.,
24.8. The seller is responsible for delivery.
25) Buyers
25.1. Only buy items you are okay with.,
25.2. Only approve delivery after inspecting your items.,
25.3. We hold your funds until you approve successful deliver.,
25.4. After approving delivery we forward the funds to the buyer.,
25.5. If you cancel purchase, the seller must acknowledge within 24 hours before funds are returned to your wallet,
25.6. We offer only two services, 1. The platform, and 2. Withholding funds till delivery (escrow)
Annex A — Returns & Refunds (Marketplace Model)
A1. Change‑of‑mind returns are at Seller’s discretion; if offered, Seller must state the window and condition requirements in the listing.
A2. For Not‑as‑Described or Damaged on Arrival, Buyer must open an in‑app dispute within 72 hours of delivery with photos/video.
A3. If a return is approved, Buyer must return the item using tracked shipping within the stated window; funds remain on hold until return is confirmed.
Annex B — Acceptable Use & Conduct
B1. Be respectful; no harassment, hate speech, or deceptive conduct.
B2. No attempts to bypass the app, solicit off‑platform payments, or share personal bank details.
B3. No scraping, reverse engineering, or security testing without written permission.
B4. No false claims, review manipulation, or rating abuse.
Annex C — Compliance Snapshot (Informative)
C1. We operate with licensed payment partners and comply with applicable Nigerian consumer protection, payments, and data protection laws.
C2. We maintain complaint‑handling, dispute processes, and records to support fair outcomes and regulatory requests.
Acknowledgement & Consent
By using our marketplace services, you confirm that you:
- Have read and understood these Terms;
- Will not make or accept payments outside the app;
- Understand BuyQuick’s limited role (platform + funds‑hold only); and
- Agree to be bound by all policies referenced above.
